The Simi Valley Police Department would like to remind Simi Valley residents that on July 1, 2008, two new laws dealing with the use of wireless telephones in motor vehicles will go into effect. California Vehicle Code Sections 23123 and 23124 are the new laws regulating the use of cell phones and other communications devices while operating a motor vehicle. The following is a description of the different facets of the new laws:
· VC (Vehicle Code) 23123 prohibits all drivers from using a handheld wireless telephone while operating a motor vehicle. Motorists 18 years of age and older may use a hands-free device while driving a motor vehicle. The new law does not prohibit dialing, but drivers are strongly urged not to dial while driving.
· VC 23124 prohibits drivers under the age of 18 from using a wireless telephone or hands-free device while operating a motor vehicle.
· There is no grace period. The law becomes effective July 1, 2008. As of that date officers will be issuing citations for this violation.
· VC 23123 allows a driver to use a handheld wireless telephone to make emergency calls to law enforcement, a medical provider, fire department or other emergency services.
· The base fine for the FIRST offense is $20 and $50 for subsequent convictions. According to the Uniform Bail and Penalty Schedule, with the addition of penalty assessments, a first offense is $76 and a second offense is $190.
· Citations for violating these laws will not cause a point to be put on one’s drivers license. However, the violation will appear on the person’s driving record.
· These laws do not affect passengers. They only apply to the person driving the vehicle.
FOR THOSE DRIVERS UNDER 18
· Drivers under 18 are not allowed to use a wireless telephone, pager, laptop or any other electronic communication or mobile services to speak or text while driving in any manner, even hands free. The ONLY exception is that provided in the case of emergency.
· Drivers under 18 may not be given permission by parents or any other person to violate the law and use a wireless telephone.
· Drivers under 18 may not use the hands-free feature while driving, even if it is a built in feature of your vehicle; again, except in emergency situations.
